Medicare pays for skilled nursing facility rehab only after a qualifying inpatient stay of at least three midnights. Observation days do not count. Ask the case manager about status early, every day if needed, and plan the discharge around the answer.
Why status matters more than the bed
A parent can spend three nights in a hospital bed at UAB, Grandview, Brookwood, Princeton or one of the St. Vincent's hospitals and still not qualify for Medicare-covered rehab afterward. The reason is status. Original Medicare Part A covers skilled nursing facility care only after a qualifying inpatient hospital stay, generally at least three consecutive midnights as an admitted inpatient. Time under observation, which is billed as outpatient care, does not count toward those three days.
Medicare Advantage plans set their own rules and some waive the three-day requirement, so check the plan's evidence of coverage. For Original Medicare, the three inpatient midnights are the gate.
How to find out your parent's status
Ask the nurse or the hospital case manager directly: is my parent an inpatient or under observation, and since when? Hospitals must give Medicare patients who have been under observation for more than 24 hours a written notice explaining that they are outpatients. If you see that notice, the clock for skilled nursing coverage has not started.
Status can change. A patient can move from observation to inpatient when the doctor writes an admission order, and the inpatient days count from that order. Ask again each day if a rehab stay is likely.
What the numbers mean for a Birmingham family
| Situation | Medicare Part A skilled nursing coverage | What families usually do |
|---|---|---|
| 3+ inpatient midnights, daily skilled need | Up to 100 days per benefit period; days 1-20 in full, 21-100 with daily coinsurance | Choose a rehab facility from the case manager's list |
| Observation only, or fewer than 3 inpatient midnights | No coverage for the nursing facility stay | Home with home health, private-pay rehab or a Medicare Advantage plan's rules |
| 3+ inpatient midnights, no daily skilled need | No skilled nursing coverage | Home, assisted living or long-term care |
At Alabama's 2025 median of about $274 a day for a semi-private nursing home room, a two-week rehab stay paid privately would cost close to $3,850. That is why the status question is worth asking on day one.
Planning the discharge itself
Whatever the status, ask what your parent will need at home or in the next setting and for how long. If assisted living is the plan, remember Alabama's rules: an assisted living facility cannot admit someone who needs ongoing skilled nursing or hospice, and cannot readmit a resident whose needs now exceed what its license allows. Short-term skilled needs can often be met with home health visits inside the facility.
If you believe the discharge is unsafe or premature, Medicare patients receive a notice of their discharge appeal rights. Calling the number on that notice requests a fast review by the Quality Improvement Organization before the patient leaves.

Questions to ask on day one
Is my parent admitted as an inpatient or under observation, and since what date and time? What is the expected length of stay? Is a skilled nursing facility likely after discharge, and has the case manager started that search? Which home health agencies serve my parent's ZIP code? Who on the care team will talk with the family about the plan, and when?
Write the answers down with names and times. If status changes, ask for the time of the admission order, because the three inpatient midnights count from that point.
If rehab is not covered
When a Medicare-covered skilled nursing stay is not available, families still have options: home with Medicare home health if the parent is homebound and needs skilled visits, a short private-pay stay in a nursing home or assisted living respite apartment, or family support with outpatient therapy. Ask the case manager to price each option before discharge day.
Frequently asked questions
Do observation days count toward Medicare's three-day rule?
No. Only days as an admitted inpatient count. Observation is outpatient care, even if the patient stays overnight in a regular hospital bed.
How long does Medicare pay for nursing home rehab?
Up to 100 days per benefit period after a qualifying inpatient stay, in full for the first 20 days and with daily coinsurance for days 21 to 100, as long as daily skilled care is needed.
Can my parent go from observation straight to assisted living?
Yes, if their needs fit the assisted living license. Alabama ALFs cannot accept residents who need ongoing skilled nursing or hospice.
How do I appeal a hospital discharge?
Use the phone number on Medicare's discharge appeal notice to request a fast review by the Quality Improvement Organization before leaving the hospital.
